Seek 7 years and 7 months prison for Marius Borg Hoiby

After a seven-week trial, Police Attorney Andreas Kruszweski and Prosecutor Sturla Henriksbo have today presented their closing arguments. The prosecution believes they have proven that Marius Borg Hoiby has committed 39 criminal acts, some of which should be considered continuous criminal offenses (there are a total of 40 counts, but the prosecution believes Hoiby should be acquitted of one violation of a restraining order). The Principle of Sentence Aggravation

In Norway, a principle of sentence aggravation is used, which results in a sentence that is shorter than if one were to sum the punishment for each individual offense. The starting point is the sentencing range for the most serious count, adding a discretionary increase for the other offenses—this functions as a sentencing discount. If one has committed several types of criminal acts against the same victim, the acts are linked to relevant points in the indictment; if acts are repetitive, a sentencing discount is given which should initially constitute approximately 50 percent. The sentencing discount is influenced by, among other things:

1. If criminal acts are committed against more than one victim, the scope of harm is considered greater and the punishment shall be stricter. This means the defendant receives a larger sentencing discount if the act is committed multiple times against the same person than if the offense is committed against multiple people.

2. If an act has led to a "serious violation of integrity" for one victim, the punishment shall be stricter than for any other victims who are not as strongly affected by the act.
